Mediation, as defined by Texas Civil Practice and Remedies Code Sec. 154.023, is a forum where an impartial person (the mediator) facilitates communication between parties to promote reconciliation, settlement, or understanding among them. The mediator may not impose their own judgment on the issues for that of the parties.
Arbitration is the hearing and settling of a dispute by a third party, allowing the dispute to be settled out of court. Many businesses and organizations now require Arbitration within their Terms & Conditions, as a way of reaching a settlement before going to court.
Both Mediation and Arbitration can be cost effective for both parties.
